The Wisconsin Department of Health Services (“DHS”) recently announced that it is extending the current civil rights compliance period for recipients of federal financial assistance through DHS. Under the extension, the current compliance period, which began January 1, 2022, will now remain in effect through December 31, 2028, rather than expiring on December 31, 2026. The next compliance period will begin on January 1, 2029.

As a reminder, organizations that receive federal financial assistance through DHS programs, including Medicaid, are subject to DHS civil rights compliance requirements. Depending on the organization, those requirements may include maintaining a current Letter of Assurance (“LOA”) and a Civil Rights Compliance Plan (“CRCP”).

The extension means that organizations that properly completed their LOA and, if applicable, their CRCP for the current compliance cycle generally do not need to submit new compliance documentation at this time. Instead, DHS has indicated that additional instructions, updated requirements and training materials will be provided before the end of the extended compliance period.

The Wisconsin Department of Children and Families has also extended its civil rights compliance period.

For those who have previously submitted a CRCP, remember to continue to comply with the terms of your plan, including regularly reviewing your previous submission.
